Earn commissions by referring people who may qualify to obtain a medical cannabis card under the new laws of the Kentucky Medical Cannabis Program. Refer patients to one of our Bluegrass CannaMed clinics and earn a commission for every paid initial patient visit. Whether you’re an online affiliate or an offline referral representative, we provide the tools and support you need to succeed.

Bluegrass CannaMed is an innovative start-up dedicated to providing compassionate care and support for patients seeking medical marijuana certifications in Kentucky. With clinics located in Louisville and Lexington, we aim to empower qualified patients by offering thorough evaluations and tailored treatment plans in accordance with Kentucky’s new medical marijuana regulations.
Our mission is to create a welcoming and informative environment where patients feel comfortable discussing their health needs and exploring the potential benefits of medical cannabis. Affiliate Terms and Conditions
Effective Date: December 3, 2024
These Terms and Conditions (“Agreement”) govern participation in the BlueGrass CannaMed Independent Rep Referral Program (“Program”). By enrolling in or participating in the Program, you (“Affiliate”) agree to the terms below.
1. Program Overview
The BlueGrass CannaMed Referral Program allows Affiliates to refer eligible patients to BlueGrass CannaMed and earn referral commissions for each Qualified Referral. This Program is designed to connect patients with compassionate medical care in compliance with Kentucky’s medical cannabis laws.
Affiliate Agreement
When signing up for the program, you will be required to agree to our Affiliate Terms of Use, which include:
· Your responsibilities as an affiliate.
· Payment details, processing fees, and timelines.
· Fraud protection measures and compliance requirements.
· Legal obligations regarding taxes and reporting.
How It Works
1. Sign Up: Complete the affiliate registration form, agree to the terms, and start earning commissions.
2. Promote: Use your unique affiliate link, QR codes, or referral ID to share Bluegrass CannaMed with your audience.
3. Earn: Receive commissions for every patient referral that results in a paid initial visit.
2. Eligibility
To participate, Affiliates must:
· Be at least 18 years old.
· Comply with all applicable laws and regulations.
· Not promote or engage in activities contrary to Kentucky medical cannabis laws or other healthcare laws.
BlueGrass CannaMed reserves the right to approve or reject applicants at its sole discretion.
3. Referral Process
· Affiliates must use their unique referral link, referral code, QR code, or forms provided by BlueGrass CannaMed to submit patient referrals.
· Referrals must include accurate and complete information about the referred patient.
· Affiliates are prohibited from offering medical advice or guaranteeing outcomes of receiving a medical cannabis card, medical cannabis written certificate or success of medical cannabis treatment plans.
4. Qualified Referrals
A “Qualified Referral” is defined as:
· A new patient who meets the legal requirements for medical cannabis in Kentucky. The new patient must schedule an initial visit for a medical cannabis consultation for the purposes
of receiving a written certification intended to be used to apply for a medical cannabis card under the laws and regulations of Kentucky.
· A patient must successfully schedule and attend their initial appointment at one of our BlueGrass CannaMed clinics.
· A patient must pay for the initial visit and any charge-backs occurring against the patient processed payment will result in disqualifying the referral for commission.
· A patient who provides complete and accurate documentation, as required by law.
BlueGrass CannaMed reserves the right to validate all referrals and determine their qualification.
5. Affiliate Compensation and Commission Details
Commission Details
· Eligibility for Commissions: Commissions will only be paid for referrals that result in a completed and paid initial visit. Any other traffic or leads sent to our website will not be eligible for compensation. Fraudulent or incomplete referrals will be automatically disqualified.
· Fraud Protection: Bluegrass CannaMed uses a robust fraud detection system to ensure valid referrals. If any fraudulent activity is detected, your affiliate account may be suspended or terminated.
Payments
· Payment Schedule: Commissions are paid out manually monthly.
· Payment Methods: Payments can be made via:
· PayPal (a $1.00 processing fee applies).
· Zelle (no fee).
· ACH Bank Transfer (no fee).
· Minimum Payout: Commissions of $50 or greater earned during the month will be paid.
· Payment Accuracy: Affiliates are responsible for providing accurate payment information and are liable for any taxes on commissions earned.
Tax Compliance
· Affiliates earning $600 or more are required to submit a valid Form W-9 to comply with U.S. tax laws.
· A 1099-NEC will be issued at the end of the calendar year for tax reporting purposes.
· Payments may be delayed if the required tax forms are not submitted in a timely manner.
6. Prohibited Activities
Affiliates must NOT:
· Make false or misleading claims about BlueGrass CannaMed, its services, or medical cannabis.
· Use spam, unauthorized advertisements, or unethical marketing tactics.
· Share referral links on platforms that promote illegal activity or violate community guidelines.
· Generating fake or fraudulent referrals, including using bots, VPS, or other deceptive methods.
Failure to comply may result in termination from the Program and forfeiture of unpaid commissions.
7. Compliance with Healthcare Laws
Affiliates are expected to adhere to all laws, including but not limited to:
· Kentucky medical cannabis laws.
· HIPAA regulations (protection of patient information).
· Anti-kickback statutes.
Affiliates must not access or use private patient information beyond what is authorized for the referral process.
8. Program Termination
BlueGrass CannaMed reserves the right to terminate this Program or an Affiliate’s participation at any time without prior notice. Reasons for termination may include, but are not limited to:
· Breach of this Agreement.
· Violation of applicable laws.
· Inactivity in the Program.
In case of termination, all unpaid commissions for Qualified Referrals will be forfeited if termination results from a violation of these Terms.
9. Limitation of Liability
BlueGrass CannaMed is not responsible for any losses, damages, or expenses incurred due to participation in this Program. Affiliates participate at their own risk.
10. Confidentiality
Affiliates agree to maintain confidentiality regarding any non-public information about BlueGrass CannaMed, the Program, and patients.
11. Modifications to Terms
BlueGrass CannaMed reserves the right to modify this Agreement at any time. Affiliates will be notified of changes, and continued participation in the Program constitutes acceptance of revised terms.
12. Governing Law
This Agreement is governed by the laws of the Commonwealth of Kentucky. Any disputes will be resolved exclusively in Kentucky courts.

14. Important Disclaimers
· Fraud Prevention: Bluegrass CannaMed reserves the right to review all referrals for authenticity and validity. If a referral is deemed invalid or fraudulent, it will not be compensated.
· Non-Qualifying Traffic: Only referrals that result in a paid initial visit are eligible for commissions. Non-converting traffic or incomplete leads will not be eligible for compensation.
· Program Modifications: Bluegrass CannaMed reserves the right to update or modify the Affiliate Program at any time. Changes will be communicated to all active affiliates.
· Account Termination: Affiliates found to violate these terms may have their accounts suspended or terminated, with any outstanding payments forfeited.
· Medical Cannabis Services: BlueGrass CannaMed are medical marijuana clinics providing consultative services to qualified patients requiring a written certification for their medical marijuana card application under the laws of the Commonwealth of Kentucky. We do not diagnose patients. We establish a bona fide patient relationship required with an IN-PERSON patient visit to our clinic and assess the potential benefits medical marijuana may have for each individual patient. During this visit a recommended medical cannabis treatment plan is designed and provided that may be used once a medical marijuana card is approved and provided by Kentucky’s Office of Medical Cannabis. We do not approve nor provide medical cannabis cards. Our clinic practitioners provide a completed Kentucky written certification to patients to apply for a medical cannabis card. BlueGrass CannaMed does not handle nor distribute medical marijuana.
